The Commercial Director is a critical role in the company overseeing project commercial structures, financial control, procurement of project participants and providing governance across project costs, risks and strategies that deliver value for money for our clients. Reporting to the Executive Director of Asset Management, the Commercial Director collaborates closely with cross-functional internal and external teams, taking a governance and stewardship role across contractual relationships and agreements, as well as project budgets and funding requirements to ensure commercial transparency across the life-cycle to support successful and smooth project delivery

· Lead the commercial oversight of projects and portfolios, providing strategic direction and monitoring delivery aligned with overall client vision and agreed objectives from a commercial & cost perspective.
· Resolve contractual and commercial matters concerning client’s projects and related stakeholders
· Undertake and ensure suitable risk assessments are done and revised across the life-cycle of all projects
· Uphold industry best practice, discovering areas that are not in-keeping with standard regulatory practices
· Reviewing/developing operational process flows as necessary to ensure project delivery is optimized
· Oversee financial KPIs for all projects and maintain reporting on the same
· Ensure that all stakeholders understand and adhere to contractual obligations
· Ensure that the financial aspects and project impact of contractual relationships are clear to all parties engaged in client’s projects
· Provide management/mentoring/training of any other internal Quantity Surveyors
· Maintain client and supplier relationship management, and related negotiations on commercial agreements.
· Direct and lead the commercial aspect of projects and portfolios of projects throughout the lifecycle of all contracts/projects, and ensure that there are effective and efficient commercial policies, procedures, and best practices in place to establish and maintain that function.
· Provide guidance and leadership in the development of procurement documents and contracting structures and oversee and develop strategies for contract negotiations and governance and to minimize corporate liability and risk throughout the contract lifecycle.
· Lead the development and implementation of appropriate commercial management plans and strategies to maximize efficient deployment of capital funding and related value, while minimizing risk to client.
· Interface with technical team members and other stakeholders for projects, developments and portfolios to ensure the successful implementation of commercial strategies. JOB DESCRIPTION
· Identify emerging commercial hot topics, issues, and risks, report contractual claims, and from the project perspective, lead the management and resolution of legal and/or commercial disputes in conjunction with the in[1]house legal team.
· Be responsible for the development and implementation of comprehensive strategies, methodologies, tools and techniques for commercial management excellence, lessons learned and continuous improvement.
· Undertake commercial activities as required to support key projects with respect to commercial management of advanced works, target price, actual costs management, cost to complete and earned value, mobilization and integration.
· Oversee the set up and management of lump sum and other commercial and construction related contracts.
· Participate in the assessment of the development / feasibility phase and early works and recommend appropriate changes to processes and resources with the aim of controlling costs and delivering value for money
. · Together with the development phase lead and, with assigned individuals, this position will oversee the assessment of spend to-date and review the outturn development phase and ensure the implementation of controls to provide certainty of cost.
· Assess the status of the current cost plans and suggest the implementation of changes to provide a more robust cost plan that provides a clear understanding of the total cost. This will be a progressive refinement and will be done with the contractor and utilization of internal information.
· Initiate dialogue to create a collaborative, transparent and constructive relationship with contractors and other project participants to enable a more mutually beneficial environment with aims to challenge target project costs in order to drive value for money for client.
· Review existing project processes and procedures and assess their viability to provide controls and information during the life of the target cost implementation period. This includes taking a lifecycle view of the target price process, identifying gaps, and providing ideas and documentation to ensure a robust end-to-end process.
· Support the building of capability within team by sharing skills, knowledge and experience, and embedding within group the tools developed to leave a legacy of best practice, including process documents, guidance material and outputs from lessons learned exercises.
· Support the resolution of issues of corporate significance, as required to recover or protect the group’s commercial reputation, and ensure value for money and sound commercial decision-making that ultimately supports our clients.
· Ensure that team operations are fiscally and ethically viable, influencing the achievement of business objectives that align with business and legislative compliance obligations.

· Mentor, coach, and develop within the project and program team, demonstrating effective leadership to ensure excellence in delivery against plans, championing a continuous improvement culture throughout all activities.
· Assist in refining and implementing processes, policies, procedures, and workflows for improved commercial management.
· Oversee the maintenance of transparent program and project commercial communications, ensuring accurate documentation.
· Receive and review regular reports on project phases, financial performance, contractual relationships and stakeholder satisfaction, provide feedback for enhancement of the same
